Is Australia a ‘Paradise’?

The Chairman of ASIC, Mr Greg Medcraft, has claimed that Australia is a ‘Paradise’ for white-collar criminals – a statement he was forced to retract by the Assistant Treasurer, Senator the Hon Mathias Cormann.

A copy of a purported Deed of Variation attested by a well known white-collar criminal has been provide to the Assistant Treasurer, along with two Deeds that confirm the entitlement of widows to receive a survivorship pension.

The document attested by the well known white-collar criminal, Ken Jarrett, purports to abrogate the right of widows of qualifying male officers to receive their survivorship pensions.

A corporate Trustee owned by the National Australia Bank (NAB) has recently assumed the responsibility for this superannuation fund established in 1913.

The President of the Richmond Football Club, Ms Peggy O’Neal, is the Legal Directors of the “NAB Trustee”.

A Trustee has a right and sometimes a duty to seek advice and directions from the court to protect the interests of the beneficiaries of the trust.

Any Trustee that came into the possession of a purported “Deed” attested by a well known white-collar criminal should seek Judicial Advice on such a document, especially when there are obvious defects with the document.
