The Chairman of ASIC, Mr Greg Medcraft, has claimed that Australia is a ‘Paradise’ for white-collar criminals – a statement he was forced to retract by the Finance Minister and Acting Assistant Treasurer, Senator the Hon Mathias Cormann.

ASIC falsely claimed to the recent Senate Inquiry into ASIC that there was “No Evidence” to confirm that the original Trust Deed of an occupational pension trust established on the 23 December 1913 had been fraudulently amended.

The original Trust Deed and valid Deeds of Variation executed before 26 August 1986 had been criminally concealed from the members and beneficiaries by a purported Trustee who had not even been lawfully appointed to the office of Trustee.

Whistle ASIC engaged in a cover-up to protect the interests its client, the National Australia Bank, the members were able to obtain copies of genuine Deeds with the assistance of the Deputy Premier and Attorney-General of South Australia, the Hon John Rau MP and his Department.

Copies of these genuine Deeds have been provided to:

  • ASIC
  • The Australian Federal Police
  • The Australian Crime Commission
  • The Commonwealth Ombudsman

A copy of a document signed by the well known white-collar criminal Ken Jarrett has also been provided to these law enforcement agencies.

Copies of the documents have also been provided to the Finance Minister and Acting Assistant Treasurer, Senator the Hon Mathias Cormann.

Australia’s Worst White-Collar Crime ultimately comes down to a simple question:

“Did a purported Deed of Variation hastily drafted when the former National Companies and Securities Commission commenced an investigation into the activities of the senior executives of Elders IXL Limited, lawfully amend the terms of an occupational pension trust established in South Australia on the 23 December 1913?”

The heads of ASIC, the Australian Federal Police and the Australian Crime Commission should surely be able to provide an answer to this question to Senator Cormann.

If this advice is provided to Senator Cormann, then he is justified in providing PROMISED compensation to victims of this superannuation fraud, in a similar manner to how the Leader of the Opposition, The Hon Bill Shorten MP, provided compensation when he was the Minister responsible for Superannuation to the victims of the Trio Capital Superannuation Fraud.
